LOS ANGELES -- A federal judge has refused to dismiss a lawsuit alleging New York Knicks player Derrick Rose and two friends drugged and gang-raped a woman.On Wednesday, federal Judge Michael W. Fitzgerald said a jury must decide whether to believe Roses contention that the woman, a former lover, consented to group sex at her home in 2013.The case could now go to trial in October, when Knicks training camp gets underway.Messages left for Roses agent, B.J. Armstrong, were not immediately returned Saturday.According to court records, the woman had been drinking at Roses Beverly Hills, California, home, and a friend helped her return home, where she vomited and fell asleep.The womans $21.5 million sexual battery lawsuit contends that Rose and the other two defendants entered her apartment the next morning and raped her.The woman believes that an unknown drug was slipped into her drink at Roses home, and she did not do any pregnancy tests or a rape kit because she was terribly ashamed and embarrassed, according to her lawsuit.Rose has denied the allegations, and his lawyer has labeled the lawsuit an extortion attempt.Defense court filings contend that the woman consented to the sex acts, invited the men to her apartment and buzzed them in through security.In denying Roses request to toss out the lawsuit, the judge said Roses version of events could well convince a reasonable jury, but there was substantial disagreement over the facts and a jury also could conclude the opposite.Rose, 27, was the NBAs 2011 MVP with the Chicago Bulls, but he has struggled with knee injuries and was traded to the Knicks in June. Hes led more than 100 laps in three of the last six Bristol races, and more than 60 in six of the last 10.Joey Logano: You can usually count on Logano starting well here. He has nine straight top-10 finishes dating back to his time before joining Team Penske, and hes won this race each of the last two years. For some reason, he clicks in this race better than the spring race, run in the daytime. His last four Bristol night races, hes averaged 85.2 DraftKings points per race. His last four Bristol day races (run early in the season), hes averaged 10.6.Kyle Larson: Larson needs good runs to make the Chase (NASCARs version of the playoffs) for the first time, and hes shown the ability to race his way through the field at Bristol. Last year in this race, he led 90 laps and had 57 fastest laps from the 14th starting position (he finished seventh) for 95 points. Earlier this year, he had another 18 fastest laps, but finished 41st. But thats the only time in four Bristol races that hes finished with fewer than 50 points.Ricky Stenhouse Jr.: Value-wise, Stenhouse usually fits nicely on your roster, and strategy-wise, hes a great Bristol play. He has three finishes in the top six over the last four races at the track. In his Sprint Cup Series career, Stenhouse has just three other top-six finishes at all other tracks combined. ' ' '
